About the GDPR

The General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) is a new regulation, where the European Commission, Council of the European Union and the European Parliament want to enhance, strengthen and unify data protection for all individuals within the EU. It also addresses the export of personal data outside the EU.

A New Data Protection Enforcement

The GDPR’s objective is to give control back to people over their personal data and to make the environment of regulation simple for local, national and international businesses by unifying this regulation. It will replace the 1995 Data Protection Directive (Directive 95/46/EC). The new law is directly binding and applicable.

GDPR – What can/should I be doing  between now and May 2018

You may be asking yourself, what can I do right now so as to prepare my organization for a possible audit after May 2018, when GDPR comes into law. Consider carrying out the following (not inclusive) activity tasks / answering these questions to help you:

  1. Assign a Data Protection Controller or a GDPR Champion responsible for your data protection / privacy obligations
  2. Ask yourself, ‘Do I hold any personal data?
  3. If it is safe and secure, how much data do you hold?
  4. What is this personal data used for?
  5. How is/is this personal data processed?
  6. Does it relate to a living person whom you can identify?
  1. Have you a legitimate basis / reason for processing it?
  2. How / where do you store it?
  3. Is it safe and secure?
  4. Should I carry out Data Privacy Impact Assessments (DPIA’s)
  5. Review / re-write all business / employee contracts
  6. Inform / train all employees on the GDPR
  7. Do any of your third party organisations /vendors/business partners process any of your personal data
